PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

LAB31 Design, LLC reserves the right to make changes to prices, specifications, discounts and product offerings without notice.  Sales by LAB31 Design, LLC aka LAB31 or their retail outlets of LAB31 merchandise are made on the terms contained in this policy.  LAB31 hereby gives notice to its objection to any different or additional terms and conditions.  Any change to these terms can only be made in writing, by an authorized representative of the seller.  Purchase of LAB31 products serves as an assent to the terms set below.  LAB31 reserves the right to change the Terms without notice

Ordering
An order is considered binding once the order has been received by LAB31 and a confirmation notice sent to the customer, which may be done electronically.  LAB31 may cancel the order at anytime for any reason, upon which the customer would receive a full refund. The customer can only change or cancel an order after order confirmation, if production has not begun.

Lead time
A lead time estimate will be provided in your order confirmation, but generally lead times for standard items run about 4 weeks.

Payment
All payments must be made in full prior to shipping.  LAB31 accepts Visa and Mastercard.  If you would like to pay by check or paypal please contact customer service.  If paying by check or paypal, payments must clear before the order will be shipped.  No sales tax is charged unless the order is delivered to a California address.

Warantee
Manufacturer's defects are covered for one year from the date of purchase.  LAB31 does not warrant against normal wear and tear, misuse, or failure to properly care for the product.  Variations in natural materials (such as wood grain and color) are to be expected and are not considered defects.  Product colors and finishes as viewed on the website might differ from the actual product.  Please contact us and ask for samples if concerned about the true color and finished use.  The first sample is free.  Additional samples are $5 each.

In case of a manufacturing defect, LAB31 will send new parts, repair the product, replace it or accept the defective product as a return, as determined necessary on a case by case basis.

Limitations of Liability
LAB31, its suppliers and all subcontractors, shall not be liable to the customer for any damages, indirect, direct or otherwise, that arise from LAB31products or a breach of the Terms. The customer's remedies set forth herein are exclusive and the liability of LAB31 with respect to the breach of this Agreement or any contract entered into between the parties pursuant hereto shall not exceed the price of the Product(s) or part on which such liability is based. To the extent that the laws of any jurisdiction do not permit limitations or exclusions of implied warranties, incidental damages and consequential damages, the above limitations may not apply. In such jurisdictions, the above limitations shall be enforced to the greatest extent permitted by applicable law.

Arbitration
These terms will be governed by the laws of the State of California, without giving effect to its conflict of laws provisions. Any claim or controversy arising in any way out of or relating to the Terms shall be filed in a court of competent jurisdiction sitting in San Francisco County, California. Both parties consent to exclusive jurisdiction in that county, provided, however than either party may elect to settle any litigation in any way arising out of or relating to these Terms of Service by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. If elected, such arbitration shall be conducted in San Francisco, California, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
